By using this website or placing an order with Lone Mountain Ammunition, you are agreeing to
the below statements and terms of sale.

Customer Affidavit

• I am not currently less than twenty-one (21) years old
• By selling or delivering ammunition and/or firearms accessories to me, LoneMountainAmmo.com is not violating any state or local law or ordinance.
• I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year
• I am not a fugitive from justice
• I am not an unlawful user or addicted to any controlled substance
• I have not been adjudicated as a mental defective and I have not been committed to any mental institution
• I am not an illegal or unlawful alien, and I am not a nonimmigrant alien
• I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions
• I have not renounced my U.S. citizenship
• I am currently not subject to a domestic violence restraining order of any kind
• I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence
• I will not conduct an unauthorized export of any defense articles

Agreement to Indemnify and Defend for Misrepresentation

If any of the above statements under the “Customer Affidavit” section of these Terms and Conditions are untrue, you agree to release, hold harmless, indemnify, and pay to defend High Alpha Media LLC (d.b.a. LoneMountainAmmo.com) and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution.

Shipping

We do our best to ensure that your product reaches your door as quickly and as trouble-free as possible. Title to your products will transfer to you once they are delivered to the address you provided at checkout, based on the delivery date and time reflected in the shipping carrier’s records. Once your products are delivered, you assume all responsibility for them, including the risk that they may be stolen or damaged. You release LoneMountainAmmo.com from all liability and responsibility for your products after they are delivered.

Shipping Destination Restrictions

LoneMountainAmmo.com does not ship outside the United States or to Alaska, Hawaii, California, Massachusetts, Chicago, New York City, or any other area within the United States where we are prohibited by law from shipping product.

Returns

Due to the unique nature of the products we sell, we only accept returns for damaged or defective products. This does not include damage to boxes or packaging, only to the products themselves. Products must be returned within 30 days of your order date.

To initiate a return, please e-mail us at sales@lonemountainammo.com so one of our representatives can assist you. Once you submit your return email, we will determine your products are eligible to be returned. If your purchase is eligible for return, we will send you a prepaid shipping label so that you can send the product back to us.

If you decide you want the product back after it has been received at our warehouse, we are happy to collect additional payment from you to cover the costs to ship the product back to you.

Release of Liability and Agreement to Indemnify and Defend

The nature of LoneMountainAmmo.com products are dangerous and great care and training are required in order to use our products safely. DO NOT USE OUR products unless you have been properly trained to operate firearms and ammunition. If you have not been trained, or if you act in an unsafe manner, using our products can result in injury or death of you and others.

By placing an order with LoneMountainAmmo.com, you agree that you alone are responsible for how the product is used by you or by any other party. You agree to release, hold harmless, indemnify, and pay to defend LoneMountainAmmo.com and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution arising from or related to the products you purchase, including, but not limited to, the use, storage, or transportation of the product. If any other party files a claim of any kind against High Alpha Media LLC (LoneMountainAmmo.com) arising out of or relating to your purchase, use, storage, or transportation of products from LoneMountainAmmo.com, you will indemnify and pay to defend High Alpha Media LLC and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution.

Jurisdiction

You agree that if you choose to file a lawsuit against High Alpha Media LLC (LoneMountainAmmo.com) or any of its owners, agents, officers, or employees, that lawsuit must be filed in a court located in Blount County, Tennessee. You agree that any lawsuit filed in any other jurisdiction shall be immediately removed to Blount County, Tennessee and that you will reimburse LoneMountainAmmo.com and its owners, agents, officers, and employees for any costs, including reasonable attorneys’ fees, they incur in defending a lawsuit or effecting its removal until the lawsuit is properly before a court in Blount County, Tennessee.

Governing Law

You agree that Tennessee law will govern (i) your purchase and use of any products from LoneMountainAmmo.com ; (ii) any information you receive from LoneMountainAmmo.com ; (iii) any legal action instituted against you by LoneMountainAmmo.com ; and (iv) any legal action you institute, or that someone else institutes as a result of your actions, against LoneMountainAmmo.com .

We value our customers and their privacy. We will not sell or distribute your personal information to anyone for any reason except what is required to complete your order. If you opt-in to our email list we will only use your information to send you emails about our products and services.
